This Acceptable Use Policy sets out the rules that apply to any website, store, e-mail system or other service that DGRWEB LIMITED hosts, maintains, builds or operates for you, and to any social media, fan page or community account we create or manage on your behalf (together, the Services). It forms part of our Terms & Conditions. You are responsible for ensuring that you, your staff and anyone using your website or pages comply with it.
Lawful use
You must not use the Services, or ask us to create, publish or host anything, that:
- breaks any applicable law or regulation in the United Kingdom or in any country where the content is directed or accessed;
- is fraudulent, deceptive or misleading, including unfair commercial practices under the Digital Markets, Competition and Consumers Act 2024 (for example false claims about products, prices or availability, or hidden fees);
- promotes or facilitates illegal goods or services, gambling without the required licence, or unlicensed financial services;
- is defamatory, obscene, threatening, harassing, hateful or discriminatory, or incites violence;
- contains child sexual abuse material, terrorist content or any other illegal content, which we will remove and report to the relevant authorities.
Online safety
If your website or community page allows users to post content or interact with each other, it may be a user-to-user service within the scope of the Online Safety Act 2023. As the operator of the service, you are responsible for assessing whether the Act applies to you and for meeting any duties it imposes, such as assessing risks, tackling illegal content, protecting children where relevant and providing reporting and complaints tools. Where moderation is part of the Services we provide, we will moderate in line with the agreed guidelines, the platform's rules and the law, and will escalate illegal content to you and, where required, to the platform or authorities.
No spam or unlawful marketing
- You must not use the Services to send unsolicited marketing e-mails, text messages or other electronic communications in breach of the Privacy and Electronic Communications Regulations 2003 (PECR) or similar laws in other countries.
- Marketing e-mails must only be sent to people who have consented or who fall within the "soft opt-in" for existing customers, must identify the sender and must include a simple way to opt out, which must be honoured.
- You must not use purchased, rented or scraped mailing lists without a lawful basis, and you must comply with the UK GDPR for any personal data you collect or use.
Security and malware
You must not:
- upload, store or distribute viruses, malware, ransomware, spyware, phishing pages, cryptocurrency miners or any other harmful code;
- attempt to gain unauthorised access to any system, account or data, or carry out port scanning, denial-of-service attacks or similar activities (offences under the Computer Misuse Act 1990);
- use the Services in a way that overloads or impairs our servers or other customers' services, or circumvent any security or usage limits;
- share your access credentials with unauthorised persons.
Intellectual property
You must not use the Services to publish or distribute content that infringes anyone's copyright, trade marks, design rights, database rights or other intellectual property, or their image or privacy rights, including pirated software, unlicensed images, music or video, and counterfeit goods. You must have the right to use all content, logos and brand names you supply to us. We will act on valid notices of infringement and may remove or disable infringing content.
No fake reviews or fake engagement
Under the Digital Markets, Competition and Consumers Act 2024, it is banned to submit, commission or facilitate fake consumer reviews, to conceal incentivised reviews, or to publish consumer review information in a misleading way. Accordingly, you must not ask us to, and we will not:
- write, post or buy fake reviews, ratings or testimonials, or post reviews pretending to be a customer;
- suppress or selectively hide genuine negative reviews in a misleading way;
- buy, sell or arrange fake followers, likes, views, comments, shares or other artificial engagement, or use bots, click farms or fake accounts;
- offer incentives for reviews without making this clear where required, or in breach of platform rules.
No impersonation; fan pages
- You must not use the Services to impersonate any person, brand or organisation, or to suggest a connection, sponsorship or endorsement that does not exist.
- Fan pages and community accounts about a person, brand, team or product you do not own must be clearly marked as unofficial (for example "fan page" or "unofficial" in the name and bio), must not use the real person's or brand's official logos or trade marks in a way that suggests the page is official, and must comply with the platform's rules on fan and parody accounts.
- You must not use the Services to collect personal data or payments from people under the false impression that they are dealing with the real person or brand.
- Paid or sponsored content and affiliate links must be labelled as advertising where required by the CAP Code and consumer protection law.
Platform rules
When we manage social media accounts, advertising accounts or other third-party platforms for you, all content and activity must also comply with those platforms' terms of service, community guidelines and advertising policies. If a platform restricts or suspends an account because of content or instructions you provided, we are not responsible for that restriction.
Monitoring, suspension and removal
- We do not routinely monitor all content, but we may investigate any suspected breach of this policy.
- If we reasonably believe that this policy has been breached, we may, without liability, refuse to publish content, remove or disable content, suspend hosting, e-mail or account access, or pause campaigns. Where reasonably possible we will contact you first and give you an opportunity to remedy the breach, unless immediate action is needed to comply with the law, to protect people or systems, or because of a request from a platform or authority.
- Serious or repeated breaches entitle us to terminate the Services under our Terms & Conditions.
- We may report illegal activity to the police or other authorities and cooperate with lawful requests for information.
Reporting a breach
If you become aware of content or activity connected with our Services that you believe breaches this policy, please report it to contact@dgrweb.com or through our contact page, with as much detail as possible (including links).
