Subject of the contract
This contract sets out the rights and obligations of the parties under the Law and the Regulation for the sale and performance of the Service or Digital Product presented on dgrweb.com and requested by the Buyer from the Seller.
Service or product, price and payment
- The name, main characteristics, scope, quantity or duration, billing period (one-off, monthly or yearly) and delivery time of the Service or Digital Product are as stated on the package page on dgrweb.com and in the Quote.
- The total price, including all taxes, is shown on the Quote and the invoice. Nous ne sommes pas actuellement assujettis à la TVA ; aucune TVA n’est donc facturée. No charge that is not on the Quote is requested. There is no physical shipping and no delivery charge.
- Prices are based on pounds sterling (GBP). Euro (EUR) and US dollar (USD) amounts are shown for information; the currency of payment is confirmed on the Quote and the invoice. Exchange-rate differences or foreign transaction fees charged by the Buyer's own bank are outside the Seller's control.
- Payment: no payment is taken on dgrweb.com. After the Quote is accepted, the Seller e-mails the invoice and the payment details privately to the Buyer. Payment is made by bank transfer or, where offered, by credit or debit card through a secure payment link from a licensed payment service provider. Card details are entered only on the payment provider's page; the Seller never sees or stores them.
- For subscription services (monthly or yearly), each period is invoiced in advance at the start of the period.
- For projects over £1,500 a deposit (normally 50%) may be requested before work starts, provided this is stated on the Quote.
Formation of the contract and pre-contract information
Before the contract is formed, the Buyer confirms that they have read the Pre-Contract Information Form, this contract and the Cancellation & Refund Policy. The contract is formed when the Buyer accepts the Quote by e-mail and the Seller confirms the order by e-mail. The Seller sends this contract, the pre-contract information and the order confirmation to the Buyer by e-mail (a durable medium) at the latest before performance starts. The Seller keeps the contract and sends it again on request. Until the Quote is accepted, the Buyer can correct any details by replying to the Seller.
Performance and delivery
- Services are performed and delivered online; there is no physical delivery.
- The delivery time stated on the package page and the Quote starts when the payment (or deposit) and the content and access needed from the Buyer have reached the Seller. The Seller performs within the time it has undertaken.
- Digital Products are delivered within one working day of payment, by e-mail with a licence and a secure download link, or by installation on the Buyer's server.
- Monthly services start within the number of working days stated on the package and continue until the Buyer cancels.
- If performance becomes impossible, the Seller informs the Buyer in writing within three days of learning this and refunds all payments received within fourteen days of that notice at the latest.
Right of withdrawal
- The Buyer may withdraw from a service contract within 14 (fourteen) days of the day the contract is concluded, without giving any reason and without any penalty.
- It is enough to send the notice of withdrawal to the Seller within this period in writing or on a durable medium, for example by e-mail to contact@dgrweb.com. A model withdrawal form is included in our Cancellation & Refund Policy; using it is optional.
- The Seller refunds all payments received within 14 days of receiving the notice, by the same method the Buyer used to pay (back to the same card, or to the account the payment came from), without any charge to the Buyer.
7.1 When the right of withdrawal does not apply
Under Article 15 of the Regulation, the Buyer cannot withdraw from:
- contracts for services whose performance has started, with the Buyer's express approval, before the withdrawal period ends (Article 15(1)(h)). The Seller only starts a Service within the withdrawal period at the Buyer's express written (e-mail) request and approval;
- contracts for services performed instantly in electronic form or intangible goods delivered instantly to the consumer, such as downloadable software, scripts or licence keys (Article 15(1)(ğ)). If a Digital Product is delivered within the withdrawal period with the Buyer's express approval, the right of withdrawal ends.
In the Buyer's favour, where a Service started at the Buyer's request within the withdrawal period has not been fully performed, the Seller refunds the price of the part not yet performed, as described in section 2 of our Cancellation & Refund Policy. These exceptions do not affect the Buyer's rights if a Service or Digital Product is defective.
Rights and obligations of the parties
- The Seller performs the Service in accordance with the Quote, with due care and within the agreed time, and delivers Digital Products as described.
- The Buyer provides the information, content, access and approvals reasonably requested in good time; delays caused by the Buyer extend delivery times accordingly. The Buyer confirms that the information given is accurate.
- The Seller's obligation to perform starts once the payment due under the Quote has been received.
- If the card used for payment is used without authorisation and the card issuer or payment provider does not pay the amount to the Seller, the Seller is released from its obligation to perform for that payment.
- If a Service is defective, the Buyer may use the optional rights under Article 16 of the Law: re-performance free of charge, a price reduction in proportion to the defect, remedying the defect free of charge, or withdrawal from the contract.
Personal data
Personal data is processed as described in our Privacy Policy and KVKK Privacy Notice.
Dispute resolution
For disputes arising from this contract, the Buyer may apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) where the Buyer lives or where the consumer transaction took place, within the monetary limits announced each year by the Ministry of Trade, and above those limits to the Consumer Courts (Tüketici Mahkemeleri). Where the law requires, mediation must be tried before a case is filed with the Consumer Courts. Applications to Consumer Arbitration Committees can also be made online through the Consumer Information System (TÜBİS) on e-Devlet. Complaints can first be sent to contact@dgrweb.com; we aim to reply in full within 14 days.
Where this contract is concluded with a consumer resident in Türkiye, the mandatory provisions of the Law and related legislation apply; the choice of law in our Terms & Conditions does not remove that protection.
Entry into force
The Buyer confirms that they have read and understood all terms of this contract and approves it by accepting the Quote. The contract enters into force on the date the order confirmation is sent to the Buyer, and a copy is sent to the Buyer with that confirmation.
